Bhatia Prestige Toy Corporation 140 Route 17, Suite 269 Paramus, NJ 07652 RE: The tariff classification of a child’s bathtub organizer, from either China or Thailand. Dear Mr. Bhatia: In your letter dated August 5, 2002, you requested a tariff classification ruling. The instant sample, which was not identified as to style or quality number, consists of a bathtub organizer in the configuration of a teddy bear. It measures about 15 inches in height and contains a textile loop at the top and a plastic suction cup on the back to facilitate its placement in the bath tub area. Your letter states that the item is composed of 100% polyester man-made fibers. Specifically, the head, arms and feet area are of a woven man-made fiber construction while the body or torso portion is of a knit open mesh construction. The back of this portion is open so that a child’s toys, etc., can be placed therein in the interest of bathroom tidiness. The applicable subheading for the product will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles ...Other. The rate of duty will be 7 percent ad valorem. There are currently no textile restraints for this merchandise. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
