Box 3165 Harrisburg, PA 17105 RE: The tariff classification of a Christmas wreath, item number 929046, from China. Dear Ms. Aldinger: In your letter dated August 14, 2002, you requested a tariff classification ruling. You are requesting the tariff classification on an item that is described as “Wreath Christmas Friends 8 inch Fabric”, item number 929046. The product is a small eight-inch grapevine wreath in two styles. Style 1 is a fabric polyester stuffed Santa holding a bag sitting on a grapevine wreath that is decorated with artificial greens, pinecones and holly berries and a wood banner that reads “WELCOME”. Style 2 is a fabric polyester stuffed Snowman holding a broom sitting on a grapevine wreath that is adorned with artificial greens, pinecones and holly berries and a wood banner that reads “LET IT SNOW”. The composition of both styles is 50 % polyester fabric, 30 % grapevine, 10 % cotton, 5 % polyester stuffing and 5 % accessories. The intended use of this item is as a Christmas decoration that will be marketed through Rite Aid’s Christmas Home Décor 2002 campaign. The proper classification will be in Chapter 95 of the HTSUSA as other Christmas ornaments. You have not requested the return of your sample. The applicable subheading for the two styles of Christmas wreaths (Santa and Snowman), item number 929046, will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: Other: Other.” The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
