Dear Mr. Weinrauch : In your letter dated July 11, 2002, you requested a tariff classification ruling on behalf of Momentrends Inc. Style E225530 is a strapless longline underwire brassiere made of a 72% nylon 28% spandex knitted fabric with a two ply lining at the garment front. Sewn into the garment side seams are two elongated triangular shaped fabric panels which extend out and wrap around the waist with ties measuring approximately three feet long. Additional features include padded cups, seven flexible stays, and a rear zipper closure. Please note that Rule No. 6 of The Textile Fiber Products Identification Act requires the use of generic fiber names when marking textile products. The applicable subheading for Style E225530 will be 6212.10.9020, HTS, which provides for Brassieres, girdles, corsets, braces, suspenders, garters and similar articles and parts thereof, whether or not knitted or crocheted: brassiere: other: other . . . of man-made fibers. The general rate of duty will be 17.1 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
