PO Box 653 Blaine, WA 98231 RE: The tariff classification of a printed plastic label or sign from Canada. Dear Mr. Pentland: In your letter dated May 8, 2002, you requested a tariff classification ruling on behalf of your client, Ad-Print (Coquitlam, BC, Canada). A sample identified as a “decal” was submitted for our examination. It is a 3½” x 5½” sheet of clear, flexible vinyl film with a release-paper backing. It is printed with a picture of a bottle of a certain ale, adjacent to which are a logo and a few words concerning the ale. You indicate that the plastic is meant to be peeled off its backing and applied to a beer cooler door. The plastic does not have any adhesives on it and is designed to adhere to a surface by static cling. The applicable subheading for the static-cling “decal” will be 4911.99.8000, Harmonized Tariff Schedule of the United States (HTS), which provides for other (non-enumerated) printed matter. The general rate of duty will be 1%. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
