NY I81694 August 20, 2002 CLA-2-70:RR:NC:2:226 I81694 CATEGORY: Classification TARIFF NO.: 7013.91.2000 Ms. Michelle Dias Princess House, Inc. 470 Myles Standish Blvd. Taunton, MA 02780 RE: The tariff classification of a lead crystal article from the Czech Republic Dear Ms. Dias: In your letter dated May 14, 2002, you requested a tariff classification ruling. A representative sample of the item was submitted and was sent to our Customs laboratory for analysis. The subject article, which is identified as item number 6534 – “Lead Crystal Heart Collectable”, consists of a lead crystal heart ornament incorporating a loop, a textile fringed tassel and a textile drawstring pouch. You stated that each ornament will be imported and sold with the tassel and pouch. The tassel, measures approximately five inches in length, contains a loop for hanging, and has a two-inch fringe. You indicated in your letter that the pouch will be used to hold and protect the glass ornament. The measurements of the pouch are five inches by three and one-half inches. A sample of this item was sent to our Customs laboratory for analysis. The laboratory confirmed that the heart ornament is made of lead crystal. The essential character of this merchandise is imparted by the lead crystal heart ornament. The lead crystal heart ornament with textile drawstring pouch and textile fringe are classifiable in subheading 7013.91.2000, Harmonized Tariff Schedule of the United States (HTS), which provides for glassware of a kind used for table, office, indoor decoration or similar purposes...other glassware: of lead crystal: valued over $1 but not over $3 each. The rate of duty will be 14 percent ad valorem. The value issue raised in your inquiry is being referred to the Office of Regulations and Rulings, U.S. Customs Service Headquarters, 1300 Pennsylvania Avenue, N.W., Washington D.C. 20229. A ruling will be issued to you from that office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
