Dear Mr. Samuels: In your letter dated March 7, 2002 you requested a tariff classification ruling. The submitted samples are a baseball uniform upper garment and pants composed of knit 100% polyester fabric. The sleeveless garment with curved tail has a full front button closure that closes left over right. The trousers have elastic at the bottom, a zippered fly and snap, and an elasticized waistband. At the knees there is reinforcement fabric. The applicable subheading for the baseball uniform top will be 6110.30.3050, Harmonized Tariff Schedule of the United States (HTS), which provides for “Sweaters, pullovers…, knitted or crocheted: Of man-made fibers: Other, Other: Other, Other: Men’s or boys’.” The rate of duty will be 32.4% ad valorem. The applicable subheading for the baseball uniform pants will be 6114.30.3060, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other garments, knitted or crocheted: Of man-made fibers: Other, Other: Men’s or boys’.” The duty rate will be 15.1% ad valorem. There are no quota restraints or visa requirements from the Czech Republic. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
