Dear Mr. Zaharatos: In your letter dated January 29, 2002 you requested a classification ruling. The submitted sample is a dyed warp knit fabric of looped pile construction that is composed of 94% nylon and 6% spandex. The pile yarns are wholly of nylon. This product weighs approximately 258 g/m2 and will be imported in 140 centimeter widths The applicable subheading for the looped pile knit fabric will be 6001.22.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for pile fabrics, including “long pile” fabrics and terry fabrics, knitted or crocheted, looped pile fabrics, of man-made fibers. The duty rate will be 17.7 percent ad valorem. This pile fabric falls within textile category designation 224. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.
