Liberati Morris Friedman & Co. 325 Chestnut St., Suite 415 Philadelphia, PA 19106-3883 RE: The tariff classification of an “Item Holder” from China. Dear Mr. Liberati: In your letter dated February 7, 2002, on behalf of Deb Shops, Inc., you requested a tariff classification ruling. The sample submitted is an “Item Holder.” The article is made of man-made pile fabric designed to resemble a soccer ball. It is stuffed with polyester fiber filling. Pellets have been inserted at the base of the article for stability. It features a plastic sheet “window” to hold reminders, pencils and pens, pictures, or other items. The applicable subheading for the “Item Holder” will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles . . . Other. The rate of duty will be 7 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
