Woodward Oneida Ltd. 163-181 Kenwood Avenue Oneida, NY 13421 RE: The tariff classification of cookware from China. Dear Ms. Woodward: In your letter dated July 13, 2001, you requested a ruling on tariff classification. The merchandise is a stainless steel wok and a stainless steel fondue pot with forks. The stainless steel wok comes with a glass cover. The fondue pot has a provision in its base for a heat source. It comes with four fondue forks The applicable subheading for wok and cover will be 7323.93.0030, Harmonized Tariff Schedule of the United States (HTS), which provides for table, kitchen or other household articles and parts thereof, of iron or steel, other, of stainless steel, other, cooking ware. The general rate of duty will be 2 percent ad valorem. The applicable subheading for the fondue pot will be 7321.13.0080, HTS, which provides for stoves, ranges, grates, cookers, barbecues, braziers, gas rings, plate warmers and similar nonelectric domestic appliances, and parts thereof, of iron or steel, cooking appliances and plate warmers, for solid fuel, portable, other. The general rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
