Dear Mr. Alberdi: In your letter dated July 18, 2001, you requested a tariff classification ruling, on behalf of HTF USA, Inc., your client. You are requesting the tariff classification on a four-piece swim trainer system. The swim trainer system includes the following: a pair of arm bands for swimming, a swim vest, a small float with handles and a large float. The product will be packaged together and sold as a complete swim trainer system. All four inflatable pieces are constructed of plastic and are bright orange in color. All four inflatable articles are functional pieces that will be used by a child or an adult, while engaged in the activity of swimming. You have not requested that the samples be returned to you. The applicable subheading for the four-piece inflatable swim trainer system will be 9506.29.0040, Harmonized Tariff Schedule of the United States (HTS), which provides for “Water skis, surf boards, sailboards and other water-sport equipment; parts and accessories thereof: Other…Other.” The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
