Dear Mr. August: In your letter dated May 24, 2001, you request a tariff classification ruling. The sample and photographs that you submit, Item #8380, Large Glow Candles, are two designs of wax-filled containers: Human Eye and Spider Web. The Human Eye consists of a white colored candle poured into a white colored sphere shaped wax container that measures approximately 3-1/2” in diameter and is decorated with two molded blue eyes that measure approximately 2-1/2” in diameter. The Spider Web consists of an orange colored candle poured into an orange colored sphere shaped wax container that measures approximately 3-1/2” in diameter and is decorated with a molded spider and spider web. Both designs of glow candles will be imported in additional colors. The applicable subheading for Item #8380, Large Glow Candles (Human Eye and Spider Web), will be will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for Festive, carnival or other entertainment articles,....Other: Other: Other. The rate of duty will be free. You have asked whether this product is subject to antidumping duties or countervailing duties.
