Hydraulic 2111 E. 37th North Wichita, KS 67219 RE: The tariff classification of a blanket/poncho/cushion from China. Dear Ms. Llamas: In your letter dated May 14, 2001, you requested a tariff classification ruling. The sample submitted is a blanket/poncho/cushion. The article is made of two textile fabric panels. One panel is constructed of nylon woven fabric with polyurethane coating which is not visible to the naked eye. The other panel is made of polyester fleece fabric. It features a 14 inch slit in the middle with a zipper closure. Attached to this opening is a textile pouch with a drawstring cord closure, which creates a hood and to roll the blanket into when not in use. This opening allows a person to drape the article over the body to form a hooded poncho to provide protection from the elements. When not in use, it is designed to fold into the hood to form a pillow or a cushion with a textile carry handle The applicable subheading for the blanket/poncho/cushion will be 6307.90.9989, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles . . . Other. The rate of duty will be 7 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
