NY H81105 August 10, 2001 CLA-2-20:RR:NC:2:228 H81105 CATEGORY: Classification TARIFF NO.: 2001.90.6000 Ms. Stephanie A Goldfischer Grunfeld, Desiderio, Lebowitz, Silverman & Klestadt LLP 33rd Floor 245 Park Avenue New York, NY 10167-3397 RE: The tariff classification of fruit and vegetables in vinegar from China. Dear Ms. Goldfischer: In your letter dated May 17, 2001, on behalf of Shonfeld’s (USA), Inc., you requested a tariff classification ruling. Three samples, ingredients breakdowns and illustrative literature accompanied your letter. The samples were forwarded to the U.S. Customs laboratory for analysis. Item FV 201918A Apricot Star Anise Infused Vinegar contains whole apricots and star anise. Item FV 201918B Spiced Citrus Berry Infused Vinegar contains whole kumquats, pearl onions, cranberries and chili pepper slices, and Item FV 202217 Citrus Berry Vinegar contains sliced oranges and cranberries. The fruit, or mixtures of fruit and vegetables, are in a liquid medium of vinegar, citric acid, salt, sodium sulfate, sodium benzoate, and potassium sorbate, packed in clear glass bottles of various sizes and shapes. Laboratory analysis found each of the products to contain over 0.5 percent acetic acid. The vinegar and cranberries are products of the United States, the apricots are products of Turkey, and the onions are products of Israel. All of the other ingredients are products of China. The applicable subheading for Item FV 201918A Apricot Star Anise Infused Vinegar, Item FV 201918B Spiced Citrus Berry Infused Vinegar, and Item FV 202217 Citrus Berry Vinegar will be 2001.90.6000, HTS, which provides for vegetables, fruit, nuts and other edible parts of plants, prepared or preserved by vinegar or acetic acid…other…other. The rate of duty will be 14 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
