Fodor Kuehne & Nagel Inc. 235 Southfield Parkway Forest Park, GA 30297 RE: The tariff classification of 100% cotton leno woven fabric from India. Dear Mr. Fodor: In your letter dated May 8, 2001, on behalf of your client APM/NNZ Industrial Packaging, you requested a classification ruling. Two samples of fabric accompanied your request for a ruling. The fabrics are identical in construction and composition and vary only in that one sample is unbleached while the second has been bleached. Both items are open-work leno woven fabrics composed of 100 percent cotton. They contain approximately 14 single yarns per inch in the warp and 5.5 single yarns per inch in the filling. Weighing approximately 58 g/m2, both these products will be imported in 81 centimeter widths. The applicable subheading for the two leno woven fabrics will be 5803.10.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for gauze, other than narrow fabrics of heading 5806, of cotton. The duty rate will be 3.4 percent ad valorem. Both leno woven fabrics fall within textile category designation 220. Based upon international textile trade agreements products of India are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
