Box 16528 Columbus, OH 43216 RE: The tariff classification of a backpack from China. Dear Ms. Kohmann: In your letter dated April 30th, 2001, you requested a ruling on tariff classification. The sample submitted is identified as style HB0701API. It consists of a traveling bag and a detachable cell phone case. The bag measures approximately 13-1/2 inches in height and is roughly cylindrical in shape with an elliptic base that measures approximately 8-1/2 inches in diameter and approximately 27 inches in circumference. The bag is lined and has an outer surface composed of 100 percent man-made textile materials. The interior of the bag features one large central compartment that is gathered at the top by means of a belt strap and buckle. There are two open pockets near the top of the interior compartment, which are suitable to hold an accessory such as a pair of spectacles, a cell phone or other device. The bag is carried over the shoulder by means of a single strap similar to a rucksack. The cell phone is attached to the bag by means of two metal snaps. The phone case is classifiable in tariff number 4202.92.9026, HTSUSA. The cell phone case, presented with the carrying bag ready for retail sale without repackaging, is classifiable with the bag as a set. The carrying bag imparts the essential character of the set. Style HB0701API is more similar to a style HBLG#1 that was part of Customs Ruling HQ961513 dated September 24th, 1998. It is designed to contain personal effects and property in addition to the small personal effects of a kind normally carried in a handbag. The applicable subheading for this product will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports, and similar bags…of man-made fibers, other. The general rate of duty will be 18.3 percent ad valorem. Items classifiable under HTS subheadings 4202.92.3031 and 4202.92.9026 fall within textile category designation 670. Based upon international textile trade agreements products of China are currently subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. Your sample is being returned as requested. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
