Dear Ms. Jacobs: In your letter dated April 23, 2001, on behalf of Co Expo Ltd., you requested a classification ruling. The samples submitted with the request will be returned to you. The submitted samples are a hood and boot from Co-Expo’s HD-ESD line. The items are static dissipative and the cut edges are overcast to prevent raveling before sewing the seam closed (serging). The items are designed for cleanrooms where bacterial filtration, static charges, particulate and fluid resistance needs to be controlled. The open-face hood is constructed of woven 99% polyester, 1% carbon fabric and drapes across the shoulders. The hood features tunneled elastic in the back for a contoured fit and rear horizontal and vertical adjustable snaps. The boot is constructed of an upper of woven 99% polyester, 1% carbon fabric with an outer sole of textile that is coated with plastic. The boot features an elasticized top opening with rear snaps and a buckled instep. The applicable subheading for the HD-ESD line hood will be 6505.90.8090, Harmonized Tariff Schedule of the United States (HTS), which provides for “Hats and other headgear…made up from lace, felt or other textile fabric…: Other: Of man-made fibers: Other: Not in part of braid, Other: Other: Other.” The duty rate will be 19.7 cents per kilogram plus 7.2% ad valorem. The applicable subheading for the HD-ESD line boot will be, as you suggest, 6404.19.50, 6404.19.70, 6404.19.80 or 6404.19.90 (HTS) depending upon the value, which you did not provide at this time. These suggested subheadings provide for footwear with outer soles of rubber or plastics and uppers of textile materials, other, other. The HD-ESD line hood falls within textile category designation 659. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
