Besler & Company 115 Martin lane Elk Grove Village, IL 60007-1309 RE: The tariff classification of a “KSQ-98 Piece Sewing Kit” from China. Dear Mr. Dorfman: In your letter dated February 28, 2001, on behalf of LTD Commodities Incorporated, you requested a classification ruling. The sample is being returned as requested. The sample submitted is a “KSQ-98 Piece Sewing Kit”, item number 542044-3KSQ. It consists of a plastic box and its contents. The plastic box measures approximately 6”L x 5”W x 6”H. The walls of the box are designed, when opened, to collapse and display various items as follows: Two of the walls contain various colors of threads on spools, and the other two walls feature compartments with buttons, metal hook-and-eye sets, metal adjustable hook-and-eye sets, various sizes of metal safety pins, a metal needle threader, dressmaker pins, colorful head pins, plastic extend-a-collar buttons, and the center compartment contains needles in a needle compact, a scissors, plastic measuring tape and a plastic thimble. The plastic box, when the sides are folded up, is secured with plastic slide fasteners. The plastic box has a collapsible plastic carry handle. These articles are put up in a kit for retail sale. The textile threads impart the essential character of this kit. The thread appears to be of man-made fibers. The applicable subheading for the “KSQ-98 Piece Sewing Kit” will be 5508.10.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for sewing thread of man-made staple fibers, whether or not put up for retail sale; of synthetic staple fibers. The duty rate will be 11.9 percent ad valorem. The “KSQ-98 Piece Sewing Kit” falls within textile category designation 200. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
