Customs Compliance Department 1617 Sixth Avenue - Suite 1000 Seattle, WA 98101-1742 RE: The tariff classification of women’s woven blazers from Hong Kong Dear Mr. Allen: In your letter dated March 26, 2001, you requested a classification ruling. The samples that you have submitted will be returned to you under separate cover. Two women’s garments, styles 3LVS3755M and 3LVS3291M, were submitted with your request. Both garments are made from 50 percent linen, 40 percent viscose and 10 percent silk woven fabric. Both garments will be marketed with coordinating pieces, trousers and skirts, in identical fabric. Style 3LVS3755M is a women’s tailored blazer that extends from the shoulders to the hips. It is constructed with four vertical panels in the back and the front. The jacket is fully lined and features lapels with a notched collar, a full front opening with a three button hidden placket closure, long sleeves without cuffs, a center back vent, a self-fabric tie belt and two pockets located below the waist. Style 3LVS3291M is a women’s tailored jacket that extends from the shoulders to the hips. The garment is constructed with a yoke and four vertical panels in both the front and the back. It is fully lined and features a pointed collar, a full front opening with a zipper closure, long sleeves without cuffs and a hemmed bottom. The applicable subheading for style 3LW3755M will be 6204.39.8060, Harmonized tariff Schedule of the United States (HTS), which provides for women’s or girls’ suit-type jackets and blazers of other textile materials. The duty rate will be 6.4 percent ad valorem. The applicable subheading for style 3LVS3291M will be 6211.49.9080, Harmonized tariff Schedule of the United States (HTS), which provides for other women’s or girls’ jackets and jacket-like garments excluded from heading 6202, of other textile materials. The duty rate will be 7.4 percent ad valorem. Styles 3LW3755M and 3LVS3291M fall within textile category designation 835. Based upon international textile trade agreements products of Hong Kong are subject to quota restraints and a visa requirement. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.USTREAS.GOV. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
