NY G89578 May 1, 2001 CLA-2-68:RR:NC:2:226 G89578 CATEGORY: Classification TARIFF NO.: 6810.99.0000 Mr. Joseph R. Hoffacker Barthco Trade Consultants, Inc. 7575 Holstein Avenue Philadelphia, PA 19153 RE: The tariff classification of an agglomerated stone article from China Dear Mr. Hoffacker: In your letter dated April 10, 2001, on behalf of your client, Consolidated Stores, Inc., you requested a tariff classification ruling. A representative sample of the item was submitted with your ruling request. The submitted sample, which is identified as “Sparkle Snowman Waterball” – P013A, is a decorative article of agglomerated stone including a glass water globe. A 100-mm water globe permanently rests on a base of agglomerated stone. The base is a decorative article of agglomerated stone depicting mounds of three-dimensional iridescent snow and a few three-dimensional “snowman” figurines. The globe, which is filled with distilled water and iridescent glitter, contains two skiing “snowman” figurines. Thus there are three-dimensional “snowman” figurines of agglomerated stone both inside and outside the glass globe, as well as three-dimensional mounds of snow of agglomerated stone outside the glass globe. The applicable subheading for the “Sparkle Snowman Waterball” –P013A, will be 6810.99.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for articles of…artificial stone, whether or not reinforced: other articles: other. The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
