Dear Ms. Yau: In your letter dated April 4, 2001, you requested a classification ruling. The provided sample will be returned as per your request. The submitted sample, Style 62974@ 112-2415AS, is a waist cincher (corset) which measures approximately 6-1/2 inches from top to bottom. The garment features two fabric layers on the front and side panels constructed of a 84% nylon 16% spandex lace fabric on the outside which is lined with a knitted 72% nylon 28% spandex fabric. The garment has two back panels constructed of a 69% nylon 31% spandex mesh fabric. Additional features include four vertical stays, six double hook and eye rear closures, four elasticized straps with adjustable garters which are sewn at the bottom of the garment, and beading sewn on the outer surface of the front and side panels. Please note that Rule No. 6 of The Textile Fiber Products Identification Act requires the use of generic fiber names when marking textile products. The applicable subheading for the garment will be 6212.30.0020, HTS, which provides for Brassieres, girdles, corsets, braces, suspenders, garters and similar articles and parts thereof, whether or not knitted or crocheted: Corsets . . . of man-made. The duty rate will be 24 percent ad valorem. The garment falls within textile category designation 649. Based upon international textile trade agreements products of Hong Kong are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
