Dear Ms. Stern: In your letter dated March 30, 2001, you requested a classification ruling. You submitted samples of four men’s cotton woven shirts which will be returned. All of the shirts are made of 100 percent cotton woven fabric. All feature full front openings with seven or eight button closures. All have long sleeves with placketed-buttoned cuffs, pointed collars, and all have curved hemmed bottoms. Style CPG-55 is made of denim fabric. It is made in either China or Hong Kong. In addition to the above, the garment features two front breast pockets and a button down collar. Style CPG-50 is made of a solid color (white), twill fabric. Made in Macau, it features a button down collar and two front breast pockets. Style CPG-65 is made of a denim fabric in either China or Hong Kong. It features a button down collar and a left breast pocket. Style CPG-58 is made in Taiwan of denim fabric. It features a left breast pocket, in addition to the other features shared in common with the three other samples. The applicable subheading for styles CPG-55, CPG-65 and CPG-58 will be 6205.20.2050, Harmonized Tariff Schedule of the United States (HTS), which provides for men’s or boys’ shirts, of cotton, other, other, other, with two or more colors in the warp and/or the filling, other, men’s. The duty rate will be 20.1 percent ad valorem. The applicable subheading for style CPG-50 will be 6205.20.2065, HTS, which provides for men’s or boys’ shirts, of cotton, other, other, other, men’s. The duty rate will be 20.1 percent ad valorem. All of the shirts fall within textile category designation 340. Based upon international textile trade agreements products of China, Hong Kong, Macau and Taiwan are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
