The tariff classification of girls’ garments from Turkey.

One Trans-Border Drive P.O. Box 800 Champlain, New York 12919 RE: The tariff classification of girls’ garments from Turkey. Dear Mr. Ralston: In your letter dated March 14, 2001, you requested a classification ruling on behalf of Paris Geneve Inc. The submitted samples will be returned as per your request. Five samples of girls’ garments were provided for review. All garments are constructed of a knitted cotton fabric in a printed floral design. Style 533 is a girls’ soft cup brassiere with a seamed front, adjustable elasticized shoulder straps, a fabric covered elasticized bottom band measuring approximately ¾ inch wide, and fabric capping at the top of the garment. Style 513 is a girls’ bikini panty with an elasticized waistband and leg openings. Style 536 is a girls’ upper body garment, similar to a T-shirt. The garment features short sleeves, capped fabric at the V-neckline, a hemmed bottom, and a “Miss Gem” embroidered label sewn on the left sleeve hem. Style 471 (sizes 4-6-6X) consists of a girls’ tank top and bikini. The tank top features ½ inch wide shoulder straps, ½ inch wide capped fabric at the top of the garment, and a hemmed bottom. The bikini panty features an elasticized waistband and leg openings. The garments will also be available as Style 571 in sizes 8-10-12-14. Style 519 is a girls’ boy leg underwear brief featuring a fabric covered elasticized waistband and a hemmed bottom. The applicable subheading for Style 533 will be 6212.10.9010, HTS, which provides for Brassieres, girdles, corsets, braces, suspenders, garters and similar articles and parts thereof, whether or not knitted or crocheted: brassieres: other: other: of cotton. The rate of duty will be 17.2 percent ad valorem. The applicable subheading for style 513, 519 and the style 471 and 571 panties will be 6108.21.0020, HTS, which provides for Women's or girls' slips, petticoats, briefs, panties, nightdresses, pajamas, negligees, bathrobes, dressing gowns and similar articles, knitted or crocheted: Briefs and panties: Of cotton: Girls’. The duty rate will be 7.8 percent ad valorem. The applicable subheading for style 536 will be 6109.10.0070, HTS, which provides for T-shirts, singlets, tank tops and similar garments, knitted or crocheted: of cotton . . . Women’s or girls’: Other: other. The duty rate will be 17.8 percent ad valorem. The applicable subheading for the style 471 and 571 tank tops will be 6109.10.0065, HTS, which provides for T-shirts, singlets, tank tops and similar garments, knitted or crocheted: of cotton . . . women's or girls': other: tank tops: girls. The rate of duty will be 17.8 percent ad valorem. Style 536 and the style 471 and 571 tank tops fall within textile category designation 339, and style 513, 519 and the style 471 and 571 panties fall within textile category designation 352. Based upon international textile trade agreements products of Turkey within textile category designations 339 and 352 are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
