Dear Ms. Csekme: In your letter dated March 3, 2001, you requested a tariff classification ruling. The provided sample will be returned as per your request. The submitted sample, style 05-2766k/Cat# 05-2766, is a women’s close fitting underwear camisole constructed of a translucent 92% nylon 8% spandex knitted fabric. Distinct heavy ribbed construction at the midriff outlines the bust area of the garment. Additional features include fabric covered elasticized spaghetti straps, fabric covered elasticized trim at the top of the garment, and a hemmed bottom. The applicable subheading for the garment will be 6109.90.1065, Harmonized Tariff Schedule of the United States (HTS), which provides for T-shirts, singlets, tank tops and similar garments, knitted or crocheted: of other textile materials: of man-made fibers . . . women’s or girls: tank tops and singlets: women’s. The duty rate will be 32.6 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
