Dear Ms. Van Den Broeke: In your letter dated March 1, 2001, on behalf of GT Enterprises Inc., you requested a classification ruling for a duffel style bag and insulated cooler bag. You have submitted two samples with your request, identified as items C&S-002 “Beach Bag Cooler” and C&S-008 “Beach Cooler”. Item C&S-002 is essentially a drawstring duffel bag with an adjustable shoulder strap. It is primarily for storage, protection, organization and portability of personal effects as well as food and beverage. It is manufactured with an exterior surface of man-made textile materials. The bag features three sections. The top section is unlined and constructed of a mesh knit fabric. The center zippered compartment and bottom insulated compartment is made of a woven textile exterior. Item C&S-008 “Beach Cooler”, is an insulated cooler bag manufactured with an outer surface of textile man-made woven fabric. The interior is composed of foam and a PVC lining. It has double web carrying handles, in addition to an adjustable shoulder strap. The top of the cooler is secured by means of a textile zippered closure. Your samples are being returned as requested. The applicable subheading for item C&S-002, the duffel style bag, will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of textile materials, other, other, of man-made fibers, other. The duty rate will be 18.3 percent ad valorem. The applicable subheading for item C&S-008, the insulated cooler bag, will be 6307.90.9907, HTS, which provides for: Other made up articles… Other, Cooler bags with an outer surface of textile material: of man-made fibers. The duty rate will be 7 percent ad valorem. HTS 4202.92.3031 and 6307.90.9907 falls within textile category designation 670. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
