Dear Ms. Jewett: In your letter dated February 15, 2001, you requested a tariff classification ruling. Samples identified as “QT Paper Nesting Gift Boxes” were submitted and are being returned to you as requested. They comprise a nested set of three round, non-corrugated paperboard boxes that are covered with design-printed paper. The smallest is 3 inches in diameter by 1½ inches in height, while the largest is 6 inches in diameter by 2½ inches in height. The boxes, which have removable lids, appear to be intended for use as fancy packing containers. The applicable subheading for the above-described articles will be 4819.50.4040, Harmonized Tariff Schedule of the United States (HTS), which provides for other (than certain enumerated) packing containers, of paper or paperboard…rigid boxes and cartons. The rate of duty will be 1.6%. We note that the sample set is not marked with its country of origin. Unless excepted by law, section 304, Tariff Act of 1930, as amended (19 U.S.C. 1304), requires such marking (e.g., “Made in China”) on imported foreign articles, and that it be legible, in a conspicuous place and sufficiently permanent to reach the ultimate purchaser. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
