Box 986 Tampa, Florida 33601 RE: The tariff classification of two warp knit fabrics from Taiwan and a “Bag-Tie” from Taiwan, China, Sri Lanka or the Philippines. Dear Mr. Laber: In your letter dated February 12, 2001, on behalf of your client David Carmichael Sourcing, Inc., you requested a classification ruling. Three samples accompanied your request for a ruling. The first, designated as item A003, is an open-work warp knit fabric composed of 100% filament polyester. The knit stitches in this product form hexagonally shaped openings distributed evenly over the fabric surface. This fabric will be imported in 78 inch widths. Your correspondence indicates that this product will be used to manufacture various diving accessories such as equipment bags. Item A023, is an open-work warp knit fabric composed of 100% filament polyester. The knit stitches in this product form hexagonally shaped openings distributed evenly over the fabric surface. This fabric will be imported in 78 inch widths. Your correspondence indicates that this product will be used to manufacture various diving accessories such as equipment bags. The item designated as a “Bag-Tie” is a universal handle manufactured from a 100% polyester woven webbing measuring one inch in width. It is formed by sewing a strip of the webbing into two connected circles. This item is used to tie together several plastic bags providing both a single handle and a mechanism for organizing the bags. The applicable subheading for the two warp knit fabrics designated as items A003 and A023 will be 6002.43.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for other knitted or crocheted fabrics, other fabrics, warp knit (including those made on gallon knitting machines), of man-made fibers, open-work fabrics. The duty rate will be 11.2 percent ad valorem. The applicable subheading for the “Bag-Tie” will be 6307.90.9989, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles…other, other, other, other, other. The duty rate will be 7 percent ad valorem. The two warp knit fabrics designated as items A003 and A023 fall within textile category designation 229. Based upon international textile trade agreements products of Taiwan are subject to quota and the requirement of a visa. The “Bag-Tie” is not currently subject to either quota restraints or visa requirements. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
