Dear Ms. Antrim-Saizan: In your letter dated February 14th, 2001, you requested a ruling on tariff classification. The samples submitted with your request consist of “Soft Cooler Bag,” #SHM-11Col, “Monster Tackle Binder-Spinner Bait, #SHM-3105-nylon, “Replacement Sheets/bags for binder,” #514M4805-nylon,” “Accessory Pockets”, #ARF510-clear PVC, and fish billy, #ARF-FB. The cooler bag measures approximately 14” x 11” x 7” and has an exterior surface of textile material of man-made fibers. The interior is insulated with thick foam and has a leak proof lining. The top opening is secured by a zippered closure and the bag has two carry handles and a shoulder strap. The item is chiefly used as a cooler; its chief use is for the storage of food or beverages at a desired temperature and also to be used in the serving of the food and beverages. The tackle binder is a travel case that measures approximately 11” x 8.5” x 3”. It has an exterior surface of textile material of man-made fibers. The interior spine of the case has two metal rings that hold several removable zippered storage bags for tackle. The zippered storage bags are made of textile material of man-made fibers and have a window of clear sheeting of plastic on the front exterior. On the front interior of the tackle binder, there are zippered mesh pockets. A carry handle is permanently attached to the case. The replacement bags are replacements for the zippered utility bags in the tackle binder. The accessory pockets are zippered utility cases of transparent sheeting of plastic. The top of the case is fitted with loops with lock attachments that allow the case to be attached to tackle boxes. The fish billy resembles a small baseball bat and is specifically designed for fishermen to kill large fish after they are caught. The fish billy will be made of wood or aluminum. The applicable subheading for the fish billy will be 9507.90.8000, Harmonized Tariff Schedule of the United States (HTS), which provides for Fishing rods, fish hooks and other line fishing tackle; fish landing nets, butterfly nets and similar nets; decoy "birds" (other than those of heading 9208 or 9705) and similar hunting or shooting equipment; parts and accessories thereof…other, including parts and accessories. The general rate of duty will be 9 percent ad valorem. The applicable subheading for the cooler bag will be 6307.90.9907, HTS, which provides for cooler bags with an outer surface of textile materials, of man-made fibers. The general rate of duty will be 7 percent ad valorem. The applicable subheading for the tackle binder case and zippered utility bags of textile material will be 4202.92.3031, HTS, which provides for travel, sports, and similar bags, with outer surface of textile materials, other, other, of man-made fibers, other. The general rate of duty will be 18.3 percent ad valorem. The applicable subheading for the zippered utility case of sheeting of plastic will be 4202.92.4500, HTS, which provides for travel, sports, and similar bags, other. The general rate of duty will be 20 percent ad valorem. Items classifiable under HTS subheading 4202.92.3031 and 6307.90.9907 fall within textile category designation 670. Based upon international textile trade agreements products of China or Taiwan are currently subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. Your samples are being returned as requested. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
