Dear Ms. Smith: In your letter dated February 7, 2001, you requested a ruling on tariff classification. Your samples will be returned as you have requested. You have sent us samples of all of the components of Flexible Intermediate Bulk Containers (FIBC). The completed bags will be used in the kaolin clay industry. The components, as described in an attached description, are: Body, and top and bottom spouts, each a square or rectangle with no further working, of 12 x 12 weave polypropylene strips which meet the dimensional requirements to be considered textile strip for tariff purposes. A top and a bottom fabric also of 12 x 12 weave polypropylene strips which meet the dimensional requirements to be considered textile strip for tariff purposes. These are squares that have been further worked by having holes cut in their centers. A form-fitted liner bag of polyethylene sheeting shaped to the dimensions of the container. The seams have been heat-sealed. Top and bottom bias tape, approximately one inch wide, of polypropylene webbing. Extended belt, approximately three inches wide, of polypropylene webbing. Six-mm petal closure rope of polypropylene. A two-foot long connecting rope, composed of braided ½” polypropylene strands formed into a four-inch loop of twisted strands at each end. Not mentioned in your letter or listed on the description, but included as samples, are petal pieces, which are squares of 10 x 10 weave polypropylene strips which meet the dimensional requirements to be considered textile strip for tariff purposes. Each is approximately 4½” square. Also included but not mentioned is a sheet of clear polypropylene, approximately 33” x 18”, labeled as “doc pouch.” In a telephone conversation with National Import Specialist Mitchel Bayer, you explained that the pouch will be imported as a finished item, not assembled in this country after the importation of these sheets. For the future, please limit your request to no more than five items. The applicable subheading for the six-mm petal closure rope of polypropylene will be 5607.49.3000, Harmonized Tariff Schedule of the United States (HTS), which provides for twine, cordage, ropes and cables, whether or not plaited or braided, of polyethylene or polypropylene, other, other. The general rate of duty will be 4.7 percent ad valorem. The applicable subheading for the two-foot long connecting rope with the looped ends will be 5609.00.3000, HTS, which provides for articles of yarn, strip or the like of heading 5404 or 5405, twine, cordage, rope or cables, not elsewhere specified or included, of man-made fibers. The general rate of duty will be 5.8 percent ad valorem. The applicable subheading for the form-fitted liner bag of polypropylene sheeting shaped to the dimensions of the container will be 3923.21.0090, HTS, which provides for articles for the conveyance or packing of goods, of plastics . . . sacks and bags (including cones) of polymers of ethylene . . . other, other. The general rate of duty will be three percent ad valorem. The applicable subheading for the top and bottom bias tape, approximately one inch wide, of polypropylene webbing and the extended belt, approximately three inches wide, of polypropylene webbing will be 5806.32.2000, which provides for narrow woven fabrics, other woven fabrics, of man-made fibers, other. The general rate of duty will be 6.4 percent ad valorem. The applicable subheading for the top and a bottom fabric both of which have holes cut in them, will be 6307.90.9989, HTS, which provides for other made-up textile articles, other. The general rate of duty will be seven percent ad valorem. The applicable subheading for the body and top and bottom spouts and the petal pieces will be 5407.20.0000, HTS, which provides for woven fabrics of synthetic filament yarn, including woven fabrics obtained from the materials of heading 5404, woven fabrics obtained from strip or the like. The general rate of duty will be 5.1 percent ad valorem. Subheading 5607.49.3000 falls within textile category designation 669. Subheading 5806.30.2000 falls within textile category designation 229. Subheading 5407.20.0000 falls within textile category designation 620. Based upon international textile trade agreements products of the Philippines are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. We regret that we cannot classify the document pouch without seeing a finished sample along with information and an illustration of how it will be used. When this information is available, you may wish to consider resubmission of your request.
