Dear Mr. Weinrauch: In your letter dated December 29, 2000, received by our office on February 7, 2001 you requested a classification ruling on behalf of Nipkow and Kobelt. You submitted five samples. Style # Z001 is made from 100 percent rayon woven fabric. The front panel is a velvet-like fabric that contains embroidery. The back panel is made from a woven damask. Style # Z002 is made from the same fabric as the above. The front panel features brocade border with some metallic yarns that creates a picture frame effect. Both covers have a zipper type closure on the back and a tassel attached to each corner. These covers measure approximately 21 inches square. Style # R001 is a table runner made from the same fabric and manner as Style # Z002 with the exception of a zipper closure. It measures approximately 14 x 72 inches. Styles #B001 is a throw constructed from the same fabric and manner as Style # Z001 with the exception of a zipper closure. Style #B002 is a throw constructed from the same fabric and manner as Style # R001 with the exception of a zipper closure. Both throws measure approximately 50 x 60 inches. As requested the samples are being returned. The applicable subheading for the table runner will be 6302.53.0030, Harmonized Tariff Schedule of the United States (HTS), which provides for bed linen, table linen, toilet linen and kitchen linen: other table linen: of man-made fibers… other. The duty rate will be 11.8 percent ad valorem. The applicable subheading for the pillow covers and throws will be 6304.99.6020, HTS, which provides for other furnishing articles, excluding those of heading 9404: other: not knitted or crocheted, of other textile materials: other: other… of artificial fibers. The duty rate will be 4.2 percent ad valorem. The table runner, pillowcovers and throws fall within textile category designation 666. Based upon international textile trade agreements products of India are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
