Robinson International, Inc. 8967 Columbine Road Suite 400 Eden Prairie, MN 55347 RE: The tariff classification of an agglomerated stone article from China Dear Mr. Anderson: In your letter dated January 3, 2001, on behalf of your client, Seventh Avenue, you requested a tariff classification ruling. A representative sample of the item was submitted and was sent to our Customs laboratory for analysis. The subject article, which is identified as “Fire Log Candelabra” – SC #5316F, is an agglomerated stone article that depicts a stack of wood logs with eleven holes molded into the logs. The item includes eleven tealight candles. The candles are placed in the holes of the logs, thus giving the item the illusion of real burning logs. You indicated that the log sculpture is placed in the fireplace and is an alternative to lighting a fire. The measurements are 24” X 10” X 11”. You indicated in your letter that the log sculpture is composed of limestone powder agglomerated with plastics material. Our Customs laboratory has confirmed that the submitted sample consisted of these materials. The applicable subheading for the agglomerated stone article with eleven tealight candles will be 6810.99.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for articles of…artificial stone, whether or not reinforced: other articles: other. The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
