Box 3549 Blaine, Washington 98231 RE: The tariff classification of a Game Shark® Pro video game enhancer, FlexiLight™ and link cable from England and China. Dear Mr. Johnson: In your letter dated November 6, 2000, you requested a tariff classification ruling, on behalf of Interact Company. You are requesting the tariff classification on a product that consists of the Game Shark® Pro cartridge, the FlexiLight™ and the link cable. The Game Shark® Pro cartridge comes loaded with dozens of game-enhancing codes, while the FlexiLight™ allows the player to operate in low-light settings. The link cable enables another player to join in playing with the first player. The three items in the package are designed for use with the hand-held Game Boy® products. The Game Shark® Pro is manufactured in England and the FlexiLight™ and link cable are manufactured in China. The complete product is classified as accessories to hand-held game machines in the HTS. The applicable subheading for the Game Shark® Pro cartridge, the FlexiLight™ and the link cable will be 9504.90.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other: Game machines, other than coin- or token operated; parts and accessories thereof.” The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
