Dear Ms. Bies: In your letter dated November 9, 2000, on behalf of your client Target, you requested a classification ruling. The submitted samples, Style #s936171, 936172, and 936173, are women’s nightgowns and robe sets. The nightgowns are sleeveless, and constructed from 100% cotton knit fabric. The garments also have v-necklines in the front and back, shoulder straps measuring approximately 2 inches in width, and hemmed bottoms. The wrap robes are constructed from 100% cotton knit fabric. The garments extend below the knee and feature long hemmed sleeves, a full front opening, two belt loops and a left chest patch pocket. The garments also have slash pockets at both sides, a belt made from the same fabric as the robe and hemmed bottoms. The belt and robe are considered a composite good, classified under the Harmonized Tariff Schedule of the United States (HTS) number as well as quota category for robes. We are returning your samples as you requested The applicable subheading for the Nightgowns, Style #s936171, 936172 and 936173 will be 6108.31.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for women's knit ...pajamas and nightdresses of cotton, women’s. The rate of duty will be 8.7% ad valorem. Style #’s936171, 936172, and 936173, Nightgowns fall within the textile category designation 351. Based on international textile trade agreements, garments imported from Turkey are subject to visa requirements and quota restraints. The rate of duty in effect beginning January, 200l, will be 8.6% ad valorem. The applicable subheading for the Robes, Style #s 936171,936172, and 936173 will be 6108.91.0030, Harmonized Tariff Schedule of the United States (HTS), which provides for women's knit nightdresses and pajamas, and similar articles, other, of cotton, other, women’s. The rate of duty will be 8.7% ad valorem. Style #’s936171, 936172, and 936173, Robes fall within the textile category designation 350. Based on international textile trade agreements, garments imported from Turkey are subject to visa requirements and quota restraints. The rate of duty in effect beginning January, 200l, will be 8.6% ad valorem. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
