Box 7152 Akron, OH 44306 RE: The tariff classification of two PU laminated, warp knit pile fabrics, for use in hunting apparel and accessory industries, from Taiwan. Dear Mr. Schott: In your letter dated September 14, 2000, which was returned for additional information, and subsequently resubmitted on October 11, 2000, you requested a classification ruling. While you seek the tariff classification for two specific styles, you submitted several samples depicting these qualities in the following five stages of production: loom state after dyeing after brushing, peaching, shearing after printing after PU laminate application You describe the first material, style M719, as 60" finished width, 100% polyester knit fabric, 2-guide bar, 28 gauge, 75D/72F, 50D/24F, dyed and heat transfer printed on one side, brushed, peached and sheared on the face side, laminated on back side with a clear polyurethane plastics film. This material, which will be imported in rolls of approximately 30-40 yards has the following weight specifications: Wt. Of Fabric: 5.5 oz/y² (186 g/m²) Wt. Of PU: 0.7 oz/y² ( 24 g/m²) Total Wt.: 6.2 oz/y² (210 g/m²) You described the second material, style M900, as being of the same construction and processing as the style described above, except that the density of the loom state cloth has been modified to yield a different weight breakdown as follows: Wt. Of Fabric: 6.5 oz/y² (220 g/m²) Wt. Of PU: 0.7 oz/y² ( 24 g/m²) Total Wt.: 7.2 oz/y² (244 g/m²) Both of these fabrics have been printed with a camouflage pattern. The New York Customs laboratory analyzed these two materials and found them to be basically as you described, except that the textile fabric portions of each style are actually of a warp knit pile construction. Subsequently, they were brushed. Chapter 60, note 1(c) reads “this chapter does not cover knitted or crocheted fabrics, impregnated, coated, covered or laminated, of chapter 59. However, knitted or crocheted pile fabrics, impregnated, coated, covered or laminated, remain classified in heading 6001.” Accordingly, the applicable subheading for the two materials will be 6001.92.0040, Harmonized Tariff Schedule of the United States (HTS), which provides for pile fabrics, … knitted or crocheted, of man-made fibers, not over 271 grams per square meter. The duty rate is 17.9 percent ad valorem. This merchandise falls within textile category designation 224. Based upon international textile trade agreements products of Taiwan are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
