Dear Mr. Singh: In your letter dated October 2, 2000, received by this office on October 12, 2000, you requested a classification ruling. You submitted three samples. Sample no. 1, described as a wiping towel, is a shop towel. The shop towel is made from 100 percent cotton woven fabric. The towel is of an osnaburg like construction. All of the edges are finished with an overcast stitch. It measures approximately 13 x 14.5 inches. Sample no. 2 is a yellow colored polishing cloth made from 100 percent cotton flannel fabric. Both sides of the fabric are slightly napped. The cloth measures 14 x 24 inches and the edges are finished with a red overcast stitch. Sample no. 3, described as a bar mop, is a cleaning cloth. It is made from 100 percent cotton terry toweling fabric. All of the edges are hemmed and it measures 13 x 23 inches. Sample no. 3 falls outside the bar mop size specifications. The applicable subheading for the shop towel ( sample no. 1) will be 6307.10.2005, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles, including dress patterns: floorcloths, dishcloths, dusters and similar cleaning cloths: other… shop towels dedicated for use in garages, filling stations and machine shops: of cotton. The duty rate will be 7.4 percent ad valorem. The applicable subheading for the polishing and cleaning cloth (samples no. 2 and 3) will be 6307.10.1090, HTS, which provides for other made up articles, including dress patterns: floorcloths, dishcloths, dusters and similar cleaning cloths: dustcloths, mop cloths and polishing cloths, of cotton… other. The duty rate will be 4.3 percent ad valorem. The shop towel, polishing and cleaning cloths fall within textile category designation 369. Based upon international textile trade agreements the shop towel is subject to quota and the requirement of a visa. The polishing and cleaning cloths are only subject to the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
