Weinberg Grunfeld, Desiderio, Lebowitz & Silverman, LLP Counselors at Law 245 Park Avenue, 33rd Floor New York, NY 10167-3397 RE: The tariff classification of a woman’s knit tube top from Hong Kong or China Dear Ms. Weinberg: In your letter dated September 19, 2000, you requested a tariff classification ruling on behalf of Blue Star Imports LP. The submitted sample, style #4868, is a woman’s tube top constructed from 70 percent lamb’s wool, 20 percent angora, 10 percent nylon knit fabric. The fabric is constructed with less than nine stitches per two centimeters measured in the horizontal direction. The garment does not provide any shoulder coverage and extends from the chest area to above the waist area. The garment features an elastic band at the top and rib knit bottom. The submitted sample will be returned under separate cover. The applicable subheading for the tube top will be 6114.10.0040 Harmonized Tariff Schedule of the United States (HTS), which provides for other garments, knitted or crocheted: of wool or fine animal hair: tops: women’s or girls?. The rate of duty will be 14 percent ad valorem. The garment falls within textile category designation 438. Based upon international textile trade agreements, products of Hong Kong and China are subject to quota and to the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
