NY F89216 July 7, 2000 LA-2-90:RR:NC:MM:105 F89216 CATEGORY: Classification TARIFF NO.: 9018.39.0050 Ms. Carolyne Deer DMC Medical Limited Shannon Free Trade Zone County Clare, Ireland RE: The tariff classification of vein irrigation cannulae Dear Ms. Deer: In your letter, dated June 27, 2000, you requested a tariff classification ruling. Per the information and samples, both the blunt and beveled vein irrigation cannulae are hollow pieces of transparent plastic, about 1.8 inches long and changing in outside diameter from about .3 inch at the wide end to .1 inch at the narrow end. You state that they are made of polycarbonate makrolon 2548. Each sample was sent in a bag marked “Non sterile sample - Not for Clinical Use” so we assume the production samples will be imported sterilized. From your description, they will be imported separately from the other elements of the Saphenous Vein Distention System, which you plan to use them in conjunction with. The applicable subheading for this item will be 9018.39.0050, Harmonized Tariff Schedule of the United States (HTS), which provides for, inter alia, cannulae and the like. The general rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
