Prospect Ave. Ste. 110 Redondo Beach, CA 90277 RE: The tariff classification of a copper “CD ROM SPACER” for a notebook computer from Japan Dear Mr. Neriah: In your letter dated June 8, 2000 you requested a tariff classification ruling on behalf of Toshiba America Information Systems, Inc. (TAIS). The part in question, TAIS part # 47K203432P00, “CD ROM SPACER,” is a copper circular piece used as a spacer for a bracket that attaches to an internal CD ROM disk drive. A sample and descriptive information was provided. The spacer is 7mm in its outer diameter, with an inner hole of 2mm in diameter. Around its center hole is a raised, circular flat flange, 3.9mm in its outer diameter and 0.7mm in height. The spacer is produced by machining a copper rod to specification. The spacer is used by inserting it into the screw hole of the CD ROM bracket, with the raised flange side going into the bracket’s screw hole. Since the bracket’s screw hole is 4mm in diameter, and the screw used to attach the bracket to the drive is 2mm in diameter, the spacer ensures a secure fit. It also prevents the screw head from being screwed in too far. As per your letter, the spacer is designed specifically and exclusively for use in Toshiba notebook PCs, and can not be used for in any other application. It is designed to match the exact specifications and dimensions for the CD ROM bracket it is used with. The applicable subheading for the “CD ROM SPACER,” part # 47K203432P00, will be 8473.30.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for "Parts and accessories (other than covers, carrying cases and the like) suitable for use solely or principally with machines of headings 8469 to 8472: Parts and accessories of the machines of heading 8471: Not incorporating a cathode ray tube: Other." The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
