Dear Ms. Antrim-Saizan: In your letter dated June 19th, 2000, on behalf of Tandem Bags of California, you requested a classification ruling. The samples submitted with your request are handbags designed to carry money, keys, and small accessories on a daily basis. Style #L2287 is manufactured of crocheted yarns of rayon. The interior of the bag is lined and has an open back wall pocket. The top opening is secured by a braided cord of the same yarn and color as the bag. The cord also serves as straps that enable the user to wear the bag as a backpack. Style #3301 is constructed of 100% nylon. Two carry straps are permanently attached to the rear of the bag that enable use as a backpack. The interior of the bag consists of two zippered compartments, the rear of which contains an open pocket. The front compartment contains multiple credit card slots, open pockets, and a pencil holder. The zippered compartments are further secured by a front flap with a center magnetic snap closure. A full-width zippered pocket is incorporated on the front of the bag. This office is unable to provide a classification decision for style 3613, mini-backpack. Your request indicates the article is of leather with PVC trim. Although the bag has an appearance of being 100 percent leather including the trim, the bag body is composed of a composite of materials that are either imitation leather or a plastic covered leather material. More detailed information is necessary in order to issue a ruling decision. Please submit: Copy of professional designs and production specifications used to produce the bag. A breakdown by value of all component materials indicating correct description of each material. Identify type of leather used and whether the leather is coated or covered with plastics on the exterior Identify the location on the bag and quantity in terms of square inches of : leather (coated or otherwise) imitation leather (fabric backed embossed plastics) The applicable subheading for #L2287 and #3301 will be 4202.22.8050, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strap…other, other, other, of man-made fibers. The duty rate will be 18.6% ad valorem. Items classifiable under HTS subheading 4202.22.8050 fall within textile category designation 670. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). Your samples are being returned.
