Dong Group Associates 15455 Conway Road, Suite 360 Chesterfield, MO 63917 RE: The tariff classification of a shoe cover and a face mask from China. Dear Mr. Dong: In your letter dated April 20, 2000, you requested a tariff classification ruling. The samples submitted are a disposable shoe cover and a disposable face mask. The shoe cover is made of spun bonded-type nonwoven polypropylene fabric with a piece of elastic band sewn around the top and extending down the center front and curling under the bottom of the shoe cover all the way to the heel. The disposable face mask is made of nonwoven polypropylene fabric. It is rectangular in shape with longitudinal triple pleats in the center to allow the items to be fitted over the nose and mouth. A metal strip is fastened within the turned down top edge to help the mask conform to the contours of the face. The face mask is fastened behind the ears with an elastic strap. The applicable subheading for the shoe cover and face mask will be 6307.90.9989, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles . . . Other. The rate of duty will be 7 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
