Dear Mr. Vroman: In your letter dated March 17, 2000, on behalf of IMS Connector Systems, 1400 Water Ridge Dr., Lewisville, TX, 75057, you requested a tariff classification ruling. The items you have submitted, contact spring, part # 1554.99.000.001.02, and a plastic white housing, part # 1554.99.0000.00.01, when assembled together form part # 1076816, which is an electrical connector. Classification of merchandise under the HTSUSA is governed by the General Rules of Interpretation (GRI’s). GRI 1 states, in pertinent part, that classification shall be determined according to the terms of the headings and any relative section and chapter notes. In accordance with GRI 1 and Note 2 to Section XVI, the applicable subheading for the Contact Spring, part # 1554.99.000.001.02, will be 8538.90.8040, Harmonized Tariff Schedule of the United States (HTS), which provides for other parts suitable for use solely or principally with the apparatus of heading 8535, 8536 or 8537: other: metal contact. The rate of duty will be 3.5 percent ad valorem. In accordance with GRI 1 and Note 2 to Section XVI, the applicable subheading for the Plastic White Housing, part # 1554.99.000.001.01, will be 8538.90.8080, Harmonized Tariff Schedule of the United States (HTS), which provides for other parts suitable for use solely or principally with the apparatus of heading 8535, 8536 or 8537: other: other. The rate of duty will be 3.5 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 CFR 177).
