Dear Mr. Epstein: In your letter dated March 9, 2000, on behalf of Avon Products, Inc., New York, New York, you requested a classification ruling. The sample is being returned as requested. The sample submitted is a sewing kit, item number PP203732. It is made of a paperboard base box with a smaller box attached to its interior. The outer box is covered with textile material. It has a detached lid. The external sides of the outer box are covered with jacquard fabric and the interior sides are covered with plain woven fabric. The interior is cushion with foam. The exterior bottom side is covered with a brushed woven fabric. The interior box is composed of a paperboard base covered on the external sides with a brushed woven fabric and the interior sides are covered with plain woven fabric. The sides of the exterior box and the interior box collapse to display a textile ribbon attached holding various sewing articles. It contains a tape measure, assorted colored threads on a cardboard sheet, yellow colored thread on a plastic bobbin, (We assume the threads are dressed for sewing with a final “Z” twist), needles, a pair of scissors, a metal thread guide and a thimble. The center of the inner box features a stand made of a cardboard base covered with jacquard fabric. Attached on top of the cardboard stand is a round textile fabric pincushion with long pins. The article is held closed by the detached lid. The lid is constructed of a cardboard base covered externally with brushed woven fabric. The interior sides of the lid are covered with brushed woven fabric. The interior top of the lid is lined with plain woven fabric. The lid has textile trimming around the sides. The outer box will measure approximately 4” x 4” x 5” or 3-1/2” x 3-1/2” x 4-1/4”. The applicable subheading for the sewing kit will be 6307.90.9989, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles . . . Other. The duty rate will be 7 percent ad valorem. The threads fall within textile category designation 200. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
