Box 97000 Redmond, WA 98073-9700 RE: The tariff classification of men’s knit garments from Indonesia and Thailand. Dear Ms. Girvin: This letter replaces NY F81977 dated February 17, 2000. In a letter dated March 3, 2000, you state that there has been a design change for Styles 033-0510 and 033-0511. The new design will have a hemmed bottom rather than a rib knit bottom. The tariff classification and the quota category remain the same. Style 004-0315 (in men’s regular sizes) is a pullover garment constructed from 100 percent cotton, 2x2 rib knit fabric that measures 10 stitches per two centimeters counted in the horizontal direction. Style 004-0315 features a partial front opening with a zippered closure; a self-fabric convertible collar; long sleeves with tubular knit cuffs and a tubular knit bottom. The same garment will be imported in men’s tall sizes as style 004-0316. Style 033-0493 (in men’s regular sizes) is a pullover garment constructed from 100 percent cotton, double knit fabric. The outside surface of the fabric measures 13 stitches per two centimeters counted in the horizontal direction. Style 033-0493 features a partial front opening with a zippered closure; a self-fabric convertible collar; long, hemmed sleeves; and a straight, hemmed bottom with side slits. The same garment will be imported in men’s tall sizes as Style 033-0494. Style 033-0510 (in men’s regular sizes) is a pullover garment constructed from 100 percent cotton, double knit fabric. The outside surface of the fabric measures 11 stitches per two centimeters counted in the horizontal direction. Style 033-0510 features a partial front opening with a zippered closure; a rib knit convertible collar; long sleeves with rib knit cuffs; woven fabric patches on the shoulders and the elbows; and a straight, hemmed bottom. The same garment will be imported in men’s tall sizes as Style 033-0511. The applicable subheading for Styles 004-0315, 004-0316, 033-0493, 033-0494, 033-0510 and 033-0511 will be 6110.20.2065, Harmonized Tariff Schedule of the United States (HTS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: men’s and boys’. The duty rate will be 18.2 percent ad valorem. Styles 004-0315, 004-0316, 033-0493, 033-0494, 033-0510 and 033-0511 fall within textile category designation 338. Based upon international textile trade agreements, products of Indonesia and Thailand are subject to visa requirements and quota restraints. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter or the control number listed above should be provided with the entry documents filed at the time this merchandise is imported.
