The submitted samples for style # G1065 are a girl’s flame-resistant nightgown and matching robe made of 100 percent polyester knit fabric. The full-length nightgown features a round neck with a partial front opening secured with a three-button closure, short cap sleeves, and a ruffled bottom. The neck and the edges of the sleeves and ruffled bottom are trimmed with lace. The full-length robe features a round neck, a full frontal opening with a three-button closure, long elasticized sleeves, and a ruffled bottom. The robe is also trimmed with lace at the neck and edge of the ruffled bottom. The nightgown and robe will be imported in girls’ sizes 4 to 14. The applicable subheading for the girl’s nightgown will be 6108.32.0025, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ slips, petticoats, briefs, panties, nightdresses, pajamas, negligees, bathrobes, dressing gowns and similar articles, knitted or crocheted: nightdresses and pajamas: of man-made fibers…girls’: other. The rate of duty will be 16.4 percent ad valorem. The applicable subheading for girl’s robe will be 6108.92.0040, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ slips, petticoats, briefs, panties, nightdresses, pajamas, negligees, bathrobes, dressing gowns and similar articles, knitted or crocheted: of man-made fibers….other: girls’. The rate of duty will be 16.4 percent ad valorem. The samples will be returned to you as requested. The nightgown falls within textile category designation 651 and the robe falls within textile category designation 650. Based upon international textile trade agreements, products of Greece are presently not subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.GOV. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
