Woolrich, PA 17779 RE: The tariff classification of two women’s sweaters from Hong Kong or China Dear Ms. Hunter: In your letter dated February 3, 2000 you requested a tariff classification ruling. The two samples that you submitted will be returned as requested. Style number 9128 is a woman’s sweater that is constructed from 100% lambswool, knit fabric with embroidered designs on the front panels, the back panel and near the sleeve openings. The outer surface of the fabric measures less than 9 stitches per 2 centimeters in the horizontal direction. The sweater features a round neckline; long sleeves; and a full front opening with 7 button closures. The neckline, sleeves, placket and the bottom of the garment are finished with crocheted stitching. Style number 9135 is a woman’s sweater that is constructed from 100% cotton, knit fabric The outer surface of the fabric measures less than 9 stitches per 2 centimeters in the horizontal direction. The sweater features a turn-down collar; a V- neckline; long sleeves with crocheted cuffs; a full front opening with 5 button closures; 2 front, patch pockets below the waist; and a crocheted bottom. The applicable subheading for style 9128 will be 6110.10.2030, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s sweaters, knitted: of wool or fine animal hair: other. The duty rate will be 16.4% ad valorem. The applicable HTS subheading for style 9135 will be 6110.20.2020, which provides for women’s sweaters, knitted: of cotton: other. The duty rate will be 18.2% ad valorem. Style 9128 falls within textile category designation 446. Style 9135 falls in category 345. Based upon international textile trade agreements products of Hong Kong and China are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
