NY E89955 December 14, 1999 CLA-2-95:RR:NC:SP:225 E89955 CATEGORY: Classification TARIFF NO.: 9505.90.6000 Ms. Julie Kimball Paper Magic Group 100 N 6th St., Suite 899C Minneapolis, MN 55403 RE: The tariff classification of a Halloween decoration from China Dear Ms. Kimball: In your letter dated November 12, 1999, received in this office on November 18, 1999, you requested a tariff classification ruling. You have submitted five samples with your inquiry. This letter will address classification of the “Alien Evil Eyes,” item #653672. The remaining products will be addressed in separate letters to you (See NY E89978 for item #651477, NY E89981 for item #653259, NY E89980 for item #653314, and NY E89979 for item #653570). The “Alien Evil Eyes” is a plastic representation of two eyes that light up and flash on and off. The device requires two “AA” size batteries (not included), that are housed inside a rear compartment. The article may be hung from a plastic loop, or it may be attached to a window via a suction cup located between the eyes. The product is intended for use as a Halloween decoration. Your sample is being returned in accordance with your request. The applicable subheading for the “Alien Evil Eyes,” item #653672, will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: other: other. The rate of duty will be free, and will remain unchanged in 2000. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
