Malina Lands’ End, Inc. 1 Lands’ End Lane Dodgeville, WI 53595 RE: The tariff classification of woven trousers from Thailand Dear Ms. Malina: In your letter dated December 3, 1999, you requested a classification ruling. You submitted three styles of men’s trousers and supplied information on each. The samples will be returned as you have requested. Style 63319 is described as 100 percent cotton men’s pleated khaki pants. The front panels have two pleats per panel. The garment features a waistband with a one-button closure, zippered fly, belt loops, front pockets, and buttoned back pockets. The bottoms are finished with an overcast stitch to prevent raveling. The size range is 28 – 44. Style 63314 is described as 100 percent cotton men’s drawstring/elastic khaki pants. The waistband, elasticized for its entire length, has a drawstring, which runs through the entire length of the waist. The garment features, in addition to the elasticized waist and drawstring a one-button closure, a zippered fly, front pockets, and back pockets, which have flaps which are fastened with snap closures. The size range is 28 – 44. Style 63321 is described as 100 percent cotton men’s plain khaki pants. There are no pleats in the front panels. The garment features a waistband with a one-button closure, zippered fly, belt loops, front pockets, and buttoned back pockets. The bottoms are finished with an overcast stitch to prevent raveling. The size range is 28 – 44. The applicable subheading for the trousers will be 6203.42.4015, Harmonized Tariff Schedule of the United States (HTS), which provides for men’s or boy’s suits, ensembles...trousers, bib and brace overalls, breeches and shorts, of cotton other, other, trousers and breeches, men’s, other. The duty rate will be 17.2 percent ad valorem. The duty rate in the year 2000 will be 17 percent ad valorem. The trousers fall within textile category designation 347. Based upon international textile trade agreements products of Thailand are subject to quota and the requirement of a visa. These same requirements exist for the year 2000. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
