Kamnitz Sharretts, Paley, Carter & Blauvelt, P.C. 75 Broad Street New York, NY 10004 RE: The tariff classification of children’s padded, sleeveless jackets from Sri Lanka, India, and Bangladesh Dear Mr. Kamnitz: In your letter dated September 13, 1999 you requested a tariff classification ruling for Paramount Apparel, Inc. The submitted sample, style 6960, is a girl’s padded, sleeveless jacket made of a nylon woven shell fabric with polyester non-woven insulation and a polyester knit lining. The garment features a full frontal opening with a zipper closure, two slash pockets, and a stand-up collar. Style 6960 will be imported in girls’ sizes 4 to 6X. Identical garments will be imported in the styles and sizes as follows: 4960, (girls’) / 4962, (boys’), from newborn to 24 months; 5960, (girls’) / 5962, (boys’), 2T to 4T; 8962, (boys’), 4 to 6X; 7960, (girls’) / 9962, (boys’), 7 to 16. The applicable subheading for styles 4960 and 4962, infant girls’ and boys’, will be 6209.30.3040, Harmonized Tariff Schedule of the United States (HTS), which provides for babies’ garments and clothing accessories: of synthetic fibers: other, other, other. The rate of duty will be 16.5 percent ad valorem. The applicable subheading for girls’ styles, 5960, 6960, and 7960 will be 6202.93.2020, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ overcoats, carcoats, capes, cloaks, anoraks (including ski-jackets), windbreakers and similar articles (including padded, sleeveless jackets), other than those of heading 6204 (con.): anoraks (including ski-jackets), windbreakers and similar articles (including padded, sleeveless jackets) (con.): of man-made fibers: other, padded, sleeveless jackets, other. The rate of duty will be 16 percent ad valorem. The applicable subheading for boys’ styles, 5962, 8962, and 9962 will be 6201.93.2020, Harmonized Tariff Schedule of the United States (HTS), which provides for men’s or boys’ overcoats, carcoats, capes, cloaks, anoraks (including ski-jackets), windbreakers and similar articles (including padded, sleeveless jackets), other than those of heading 6203 (con.): anoraks (including ski-jackets), windbreakers and similar articles (including padded, sleeveless jackets) (con.): of man-made fibers: other, padded, sleeveless jackets, other. The rate of duty will be 16 percent ad valorem. The sample will be returned to you as requested. The babies’ padded, sleeveless jackets fall within textile category designation 239. Based upon international textile trade agreements, as products from Sri Lanka, India, and Bangladesh, this merchandise is not subject to quota and the requirement of a visa. The girls’ and boys’ padded, sleeveless jackets fall within category designation 659. Based upon international textile trade agreements, as products from India, this merchandise is subject to quota and the requirement of a visa. Based upon international trade agreements, as products from Bangladesh and Sri Lanka, this merchandise is not subject to quota, but does require a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.USTREAS.GOV. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
