Box 100 Elverson, PA 19520 RE: The tariff classification of textile fabric baby carrier from China. Dear Ms. Dawson: In your letter dated July 7, 1999 you requested a tariff classification ruling. The submitted sample is a carrier designed to carry an infant or small toddler on one’s back. This item is manufactured so the carrier may also be adjusted to carry the infant in the front. The carrier is constructed from woven fabric that has been stuffed with both polyester fiberfill and foam plastic. The carrier features two padded shoulder straps and a waist strap to balance the weight of the infant. This item also comes equipped with a woven fabric cover which snaps onto the carrier and may be used to afford the infant with extra protection when conditions dictate. The applicable subheading for the baby carrier will be 6307.90.9989, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles, including dress patterns, other, other, other, other, other. The rate of duty will be 7 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
