Dear Mr. Kelly: In your letter dated July 23, 1999 you requested a tariff classification ruling on behalf of Jones Apparel Group. The samples will be returned. Style U21830478 is a woman’s knitted tank styled garment of 100% cotton. The garment measures less than nine stitches per two centimeters in the horizontal direction, has a round neck and shoulder straps measuring 1 ½ inches in width.. Style U1C475427 is a woman’s anorak of 100% cotton knitted fabric. The garment is lined with french terry and features a hood, long raglan sleeves with ribbed knit cuffs, a zippered frontal opening, front zippered pockets and a drawstring hem. The applicable subheading for style U21830478 will be 6110.20.2020, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers…and similar articles, knitted or crocheted, of cotton, other, other, sweaters, women’s. The rate of duty will be 18.6%. The applicable subheading for style U1C475427 will be 6102.20.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girl’ overcoats, carcoats, capes, cloaks, anoraks…and similar articles, knitted or crocheted, other than those of heading 6104, of cotton, women's’. The rate of duty will be 16.4%. Style U21830478 falls within textile category designation 345 and style U1C475427 falls within category 335. Based upon international textile trade agreements, products of Hong Kong are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
