Box 612369 DFW Airport, TX 75261 RE: The tariff classification of various uninterruptible power supplies from Taiwan. Dear Ms. Trout: In your letter dated February 23, 1999 you requested a tariff classification ruling on behalf of Para Systems, Inc. of Carrollton, Texas. The merchandise is described in your letter as uninterruptible power supplies. Your ruling request identifies the MCP Series of Uninterruptible Power Supplies as containing the following models: ? Model MCP1000, MCP1000i (capacity of 1000VA and 700W) ? Model MCP2000, MCP2000i (capacity of 2000VA and 1400W) ? Model MCP3000, MCP3000i (capacity of 3000VA and 2100W) The above models are for the U.S. market and run on 120, 208 and 240 volts. Those models designated with an ?i? are for the international markets and run on 220, 230 and 240 volts. The product literature submitted indicate these power supplies may be used with both automatic data processing machines as well as with telecommunications equipment. These power supplies are classified under heading 8504.40. Because they have applications in both data processing and telecommunications equipment, these units, in accordance with GRI 6 and GRI 3(c), will be classified in the subheading which occurs last in numerical order. -2- The applicable subheading for the MCP Series of Uniterruptible Power Supplies will be 8504.40.8500 which covers ?Static converters...For telecommunication apparatus?. The rate of duty from Taiwan is free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
